Stuart Clark is internationally recognised as one of Australia’s most experienced litigators and has been intimately involved in the development of Australia’s product liability law since 1989. He has acted in some of Australia’s largest and most complex commercial litigation, class action and product liability claims, particularly those involving complex scientific and medical issues.
Stuart is part of the team that has been at the forefront in developing both the procedural and substantive law in this area of practice and has defended claims bought by the major plaintiff law firms. Over the years, he has successfully resolved class action and analogous litigation by means including strikeouts; devised innovative settlement schemes; and, where required, conducted the defence of contested hearings. He understands the tactical and procedural nuances of class action litigation and works with clients to develop strategies to address them. He is also engaged to provide strategic advice to boards and senior executives in relation to high-level issues and tactics.
Stuart is a member of the International Association of Defense Counsel (IADC) (board member 2002–2004), the American Bar Association (ABA) and the International Bar Association. He is co-chair of the ABA’s international class actions committee.
He speaks and publishes extensively, both in Australia and overseas, in relation to class actions and product liability issues. In 2010 he was appointed an adjunct professor by Macquarie University Law School. He also serves as a director of the Law Council of Australia, the peak national representative body of the Australian legal profession, and currently serves as the firm’s managing partner (international).
