One of the firm’s founding partners, Peter Gad Naschitz initiated and heads the firm’s involvement in the insurance, maritime, banking and litigation areas and has been the cornerstone for the firm’s international practice in representing leading worldwide firms, banks, insurers, re-insurers and ship-owners.
Mr. Naschitz acts for major Israeli and international insurance and reinsurance companies, rendering advice, providing general representation in litigation and subrogation matters, as well as assisting with regulatory issues for leading U.S. and U.K. insurers with respect to licensing in Israel. Mr. Naschitz also heads the firm’s representation of mass tort and class action claims.
Mr. Naschitz’s practice in maritime law includes recovery and subrogation claims, large total loss claims, average and salvage cases and arbitrations. Mr. Naschitz has advised on transactions involving ship acquisitions and financings. On many occasions, the Government has appointed Mr. Naschitz as a receiver for the sale of ships by the courts.
Over the years, Mr. Naschitz has represented several leading international banking institutions and has provided general advice on local and international sophisticated transactions. In addition, Mr. Naschitz has represented these institutions in all aspects of litigation.
Heading up the firm’s civil litigation practice, focusing on tort, contract, banking, administrative, class actions and intellectual property issues, Mr. Naschitz appears regularly before courts countrywide and in international arbitrations – and has been involved in many landmark decisions.
Insurance Law Practice:
Designated by LEGAL 500 as the “Leading Insurance Firm in Israel”, Naschitz Brandes Amir acts on behalf of all major Israeli and international insurance and reinsurance companies – rendering advice, providing general representation in litigation and subrogation matters, and performing regulatory work for leading US and European insurers.
A few examples of complex matters, in which the firm has been involved, include tobacco claims totaling over $5 billion, a $100 million claim over the Kishon River pollution, the Ramat Hovav air pollution claim, the Maccabia Bridge Collapse (over 80 claims), fire claims amounting to hundreds of millions of dollars (Elisra, the destruction by fire of the Netanya IKEA building, the Beit Mercazim fire and many others), and complex product liability cases.
Of special note, the firm won an important case in the issue of sovereign immunity in August 2010 when Israel’s Supreme Court decided that the United States government does not enjoy immunity from claims before the courts of Israel. The claim was for bodily injuries (and loss of lives) caused to US Marines who suffered the loss and damage while on a taxi ferry which transferred them from the shore in Israel, back to the U.S.S Saratoga, which was parked within the territorial waters of Israel.
