Berend Crans has a broad finance practice. In addition to general banking and finance transactions, he specialises in asset and project finance. Throughout his career at De Brauw, he has represented lessees, lenders and equity investors in numerous cross-border lease transactions. He has played a pioneering role in designing new transaction structures and restructuring existing structures to accommodate new asset classes. He also advises clients in structured finance transactions and debt restructurings.

Berend has particular expertise in aviation law and aircraft finance and has been involved, mainly as lender counsel, in many aircraft finance transactions, including JLLs, GLLs, ECA supported transactions, acquisitions of aircraft lease portfolios and securitisations. Berend has represented lessors and lenders in airline insolvencies. He is a guest lecturer in aircraft finance in the Advanced LLM Programme in Air & Space Law of the International Institute for Air and Space Law at Leiden University. Berend is De Brauw’s expert on matters and developments in African jurisdictions.

Aviation Law Practice:

We have formed our Aviation Industry practice group from leading lawyers across various different practice areas of the firm. These include competition and regulatory, public law, commercial litigation and arbitration, mergers and acquisitions, as well as asset and structured finance.

As a result we are able to advise on a variety of matters arising in the aviation industry. We have been involved in various mergers and alliances in the aviation industry, airport privatisations, regulatory (including licensing, slot allocation and environmental matters), liability and insurance and leasing and financing – covering not only leasing and financing of aircraft and engines, but also project finance transactions in respect of airports and securitisation transactions in respect of, for example, aircraft lease portfolios.

We also have broad experience in the railroad industry, being advisers to Dutch Railways since 1875. We continue to be involved in the structural changes in the rail industry as well as in matters concerning the leasing and financing of railroad rolling stock (and similar equipment such as metro cars) as well as in rail infrastructural projects,including PPP transactions.

Concerning other transportation sectors and equipment, including buses and vessels, we have been involved in advising on major financing transactions.
