Christopher Beeson

He also has expertise in effectuating 1031 tax deferred exchanges in investment properties.

Chris and Ruth Nyqvist, one of the firm’s senior real estate paralegals, provide a cost effective and experienced team approach to engagements for the firm’s clients.

Chris is a member of the American College of Real Estate Lawyers, and the Idaho State Bar (Real Property and Ethics Sections).

Chris has been selected to the American College of Real Estate Lawyers and The Best Lawyers in America under Real Estate Law. He is a lecturer on commercial real estate and business transaction topics for the Idaho Law Foundation and industry groups and has been a participant in the Georgetown University Law Center Advanced Commercial Lease Institute.

Chris is active in community affairs as a past trustee of the Epilepsy Foundation of Idaho, a past president and trustee of the Boise Art Museum and a past president of the Boise Contemporary Theater. He is a past president and past director of the Idaho Historical Preservation Council. He is from northern Idaho and before joining the firm worked in the construction and timber industries. He also spent several years as an artillery officer stationed in Germany.

The Real Estate Law Practice:

Attorneys in our Real Estate and Land Use practice group help our clients buy and sell, entitle, finance, and develop real property throughout Idaho and the region. We have experience with a wide variety of properties—from regional shopping centers, manufacturing plants, office buildings, and residential projects to nature preserves, destination resorts, and agricultural operations.

We have a long and successful track record of helping developers and landowners navigate the land use entitlement and public hearing process on issues relating to conditional use permits, planned developments, rezoning, subdivisions, comprehensive plan amendments, annexation, variances, special exceptions, development agreements, transportation and site access, impact fees, and building code compliance. Givens Pursley publishes a leading manuscript on Idaho Land Use Law.

We represent creditors and debtors in all aspects and types of commercial real estate finance transactions, including conventional, conduit, mezzanine, tax increment financing, public bonding, and other alternative finance structures. We have expertise in structuring, negotiating, documenting, and closing commercial real estate finance transactions, and creating and perfecting liens in all types of real property and other tangible and intangible property. We also render legal opinions required to document and close commercial real estate transactions. We represent developers, institutions, and other owners in the negotiation and enforcement of design and construction contracts.

We have developed extensive expertise in the niche practice area of road and public access law. Private road law issues (right-of-way easements and the like) are a staple of real estate practitioners. The law of public roads and public access, however, is a specialty combining a detailed knowledge of the current and past state of Idaho common and statutory law, application of obscure federal statutes such as R.S. 2477, and research into local history drawn from diffuse and varied sources. We represent both private landowners and governmental entities and agencies in this area.

Givens Pursley LLP:

Givens Pursley was founded in 1977 by attorneys Ray Givens, Chuck McDevitt, Ken Pursley and Jay Webb. These four young lawyers came together and formed Givens Pursley on two founding principles. The first founding principle held that attorneys should be equally dedicated to their communities as they are to practicing law. The second was that clients should be served by attorneys with experience relevant to their needs.

Over the 40 years since its inception, Givens Pursley has upheld these principles by employing more than 100 of Idaho’s brightest legal minds with records of public service, extensive experience in their practices, and a desire to better serve clients and the community. Now, occupying a historic building across the park from the Capitol, Givens Pursley is one of the largest and most diverse law firms founded and headquartered in Idaho.

David Madden

Many of Dave’s clients are facing the age-old business challenge of reaching their goals while maximizing the value of legal counsel provided in service of achieving those goals. Dave offers a pragmatic and collaborative approach, working together with his clients to efficiently reach those business goals. Dave’s team-based approach helps clients understand the challenges before them, and creates a sound, strategic approach to overcoming them. Working through legal issues side-by-side with their counsel gives many clients a sense of the tangible value Dave brings to each and every project.

Case Studies / Success Story:

One of Dave’s clients was a lender engaged in the financing of an upscale condominium project. The borrower/developer was in default, and the client was considering taking title to a number of the condo units. Dave advised the client that if they took title they could potentially be liable for certain construction defects in the condominium unit. Dave’s counsel helped the client avoid a potentially massive liability pitfall and kept them from risky litigation exposure. By taking the time upfront to critically assess all of the client’s options, Dave was able to save the client time and navigate the client through a situation rife with the potential for exposure to significant liability.

Our experienced legal team can assist you with complicated zoning codes and building approvals. We can advise you on preventing or resolving issues with potential opponents of your project. And we can guide you in the structuring and documentation of loan agreements or transactions involving equity investors.

If you’re considering seeking advice from counsel, here’s what we suggest you keep in mind:

  • You want to be advised up front about the potential challenges and expenses you may face in your effort to obtain zoning and land use approval and financing.
  • You want your counsel to have significant knowledge of your local zoning codes and issues involving the financing of your project.

The Real Estate Law Practice:

Some clients deal with real estate as their main business, while others outside the industry may engage in opportunities to lease, buy, sell, and finance property. Whether they are building on real estate, have permitting issues, or seek council regarding the timing of sales, advantages of leasing, or other issues, clients rely on our attorneys to provide advice based upon relevant experience and successes.

Kleinbard LLC:

For over 75 years, Kleinbard attorneys have served as trusted advisors and advocates for clients to help them achieve their goals. Kleinbard offers clients sophisticated legal representation that focuses on collaborating with the client to devise the best possible strategy for resolving their issue-whether by winning a dispute, closing a deal, or achieving legal compliance. Kleinbard’s clients appreciate the firm’s approach to legal work – goals are defined, lines of communication are fostered, and matters aren’t overstaffed. Providing exceptional service is at the heart of everything that Kleinbard attorneys do.

The Firm’s clients run the gamut from publicly-held multinationals and fourth generation family-owned businesses, to technology start-ups and high net worth individuals, to nonprofits and governmental agencies.

Kleinbard’s lawyers are products of some of the country’s best law schools and were trained at large national law firms. Because the Firm does not hire lawyers who have just completed law school, our clients are spared the cost of training new associates. Just as important, because the Firm’s lawyers have decided to practice in a smaller setting after having trained at large firms, we do not experience the turnover typical of many law firms. As a result, our clients develop long-term relationships with the lawyers who work on their matters, and we gain a multi-faceted understanding of our clients’ businesses.

The Real Estate Law Practice:

The law of property has been progressively systematized and mere knowledge of the regulations does not suffice for successful real estate management. It is important to have good knowledge of the current legal environment and its developmental initiatives, as the value of property (in all its forms) is not limited in terms of time. The knowledge of current and future business practice regarding different types of property law is crucial to a sound advice, and only sound advice has a lasting value.

Because the area of real estate management is related to various other fields of law, team work is not just a desired feature in legal counsel, but it is absolutely necessary. Thorough analysis and one’s own conclusions should comprise the foundation of the decision making process, as the perceived information can only function as the basis for one’s own research, and only accuracy and one’s own conclusions can guarantee a success.

Jadek & Pensa:

Jadek & Pensa is one of the leading commercial law firms in Slovenia currently consisting of 9 partners, 8 associates and a team of junior lawyers. Christoph Sieger

Dr. Sieger is resident partner of the firm in the Bávaro, Punta Cana office and head of the firm in the eastern region of the Dominican Republic (Punta Cana, Bávaro, La Romana, Bayahibe, Miches). He received his Doctorate in Law at the Christian Albrechts University in Kiel, Germany (magna cum laude). He later did postgraduate studies in International Tax Law at the Robert Kennedy University in Zurich, Switzerland and obtained his degree in Dominican Law at UAPA University in Santiago, Dominican Republic (magna cum laude).

His international background and legal training —Doctorate in German Law, postgraduate studies in International Tax Law in Switzerland, law degree in Dominican Law— provides him with a unique perspective: understanding the needs, expectations and concerns of the foreign investor in the Dominican Republic, while knowing the ins and outs of its legal system and customs.

Dr. Sieger is the legal advisor to major international hotel chains, resorts, condominium projects, and real estate developers on real estate, tourism, corporate, construction, labor and tax matters. He is also an expert on international taxation and estate planning.

He lectures nationally on tax and corporate law and internationally on Dominican real estate law. He is currently the President of the Dominican German Chamber of Commerce.

The Real Estate Law Practice:

Guzmán Ariza’s real estate department is unsurpassed in its skill, experience and geographical reach. With eight offices throughout the island, we advise more clients in more transactions and locations than any other law firm in the Dominican Republic. Our top-ranked department works as a cohesive team with other disciplines, including tax, financing, environment, and litigation to ensure that all issues that could impact a transaction are properly and thoroughly addressed.

Our name partner, Fabio J. Guzman Ariza, has published the only annotated version of the Dominican real estate statute: Ley 108-05 de registro inmobiliario, comentada, anotada y concordada con sus reglamentos. He is also the leading authority in the country in the field of condominium law, and has published the only annotated version of the Dominican condominium statute: Ley 5038 de 1958 sobre condominios, comentada, anotada y concordada con la ley 108-05 de registro inmobiliario, con su formulario.

In addition, it is important to note that most real estate transactions, especially in the tourism industry, take place in regions far away from the country’s capital city of Santo Domingo, which is not a major tourist destination. For this reason, the fact that we have offices in Santo Domingo and in every developed tourist destination – where they are generally the largest – give us a decisive competitive advantage over other firms, since we can provide clients in those regions with more cost-efficient and timely service than our competitors, not to mention that our lawyers are abreast of many local issues ignored by our colleagues in other firms.
